Common use of Failure to Provide Adequate Assurance Clause in Contracts

Failure to Provide Adequate Assurance. In the event Tenant is unable to (i) cure its defaults, (ii) reimburse the Landlord for its monetary damages, (iii) pay the rent due under this Lease, and all other payments required of Tenant under this Lease on time (or within five (5) days), or (iv) meet the criteria and obligations imposed by Section 11.2(e) above, Tenant agrees in advance that it has not met its burden to provide adequate assurance of future performance, and this Lease may be terminated by Landlord in accordance with Section 11.2(a) above.

In the event Tenant is unable to (i) cure its defaults, (ii) reimburse the Landlord for its monetary damages, (iii) pay the rent due under this Lease, Lease and all other payments required of Tenant under this Lease on time (or within five three (53) days), or (iv) meet the criteria and obligations imposed by Section 11.2(eParagraph 26.5(d) above, Tenant agrees in advance that it has not met its burden to provide adequate assurance of future performance, and this Lease may be terminated by Landlord in accordance with Section 11.2(aParagraph 26.5(a) above.
