Common use of Failure to Provide Clause in Contracts

Failure to Provide. At Sublandlord's option, Subtenant's failure ------------------ to deliver a statement within the time required by Paragraph 19.1 above, will be conclusive upon Subtenant (i) that this Sublease is in full force and effect, without modification except as may be represented by Sublandlord, (ii) that there are no uncured defaults in Sublandlord's performance hereunder or in Landlord's performance under the Lease, and

Failure to Provide. At Sublandlord's option, Subtenant's failure ------------------ to deliver a statement within the time required by Paragraph 19.1 20.1 above, will shall be conclusive upon Subtenant (i) that this Sublease is in full force and effect, without modification except as may be represented by Sublandlord, (ii) that there are no uncured defaults in Sublandlord's performance hereunder or in Landlord's performance under the Lease, andand (iii) that not more than one month's rent has been paid in advance, or such failure may be considered by Sublandlord as a material default by Subtenant under this Sublease.

At Sublandlord's option, Subtenant's failure ------------------ to deliver a statement within the time required by Paragraph PARAGRAPH 19.1 above, will be conclusive upon Subtenant Subtenant: (i) that this Sublease is in full force and effect, without modification except as may be represented by Sublandlord, ; (ii) that there are no uncured defaults in Sublandlord's performance hereunder or in Landlord's performance under the Lease; and (iii) that not more than one month's rent has been paid in advance, andor such failure may be considered by Sublandlord as a material default by Subtenant under this Sublease.

Failure to Provide. At SublandlordSublessor's option, Subtenant's failure ------------------ to deliver a statement within the time required by Paragraph 19.1 Section 24(a) above, will be conclusive upon Subtenant (i) that this Sublease is in full force and effect, without modification except as may be represented by SublandlordSublessor, (ii) that there are no uncured defaults in SublandlordSublessor's performance hereunder or in Landlord's performance under the Master Lease, and
