Common use of Failure to Submit Clause in Contracts

Failure to Submit. a) Failure of a Member who is eligible for an annual increment to submit the annual report by the specified time limit will result in the delay of the decision whether to award or deny the annual increment until such time as the report is submitted. If awarded, the payment of the appropriate monthly portions of the increment shall be effective on the first of the month following submission of the report or July 1 immediately following the due date, whichever is later. b) Failure of a Member who is ineligible for an annual increment to submit the annual report by the specified time limit will result in the Member not accumulating sabbatical credit until January 1 or July 1, whichever is the closest date next following submission of the report.
