Failure to Timely Pay. If you fail to timely pay any amounts owed to GIA under this Agreement and if you provided to GIA a credit card number, then you hereby authorize GIA to charge the credit card those amounts that you have failed to timely pay. In addition, if you fail to timely pay GIA, GIA may in its discretion and notwithstanding anything to the contrary in this Agreement, withhold/retain Articles, Service Results, and/or access to Reports until GIA has received payment from you of all applicable fees.

Failure to Timely Pay. The Construction Manager agrees that if it fails to make payments in accordance with these provisions, the City may take any one or more of the following actions: 1. Hold the Construction Manager in default under this Agreement. 2. Withhold future payments, including retention, until proper payment has been made to Subcontractors or suppliers in accordance with these provisions. 3. Reject all future offers to perform work for the City from the Construction Manager for a period not to exceed one year from Substantial Completion date of this Project. 4. Terminate this Agreement. 5. Make a claim against the bonds required pursuant to Article 11.
Failure to Timely Pay. If Generator fails to pay the amount billed by Georgia Power within twenty (20) Calendar Days after the date of Georgia Power's invoice (and such amount is not disputed in accordance with Section 10.6), Georgia Power may, at any time thereafter upon five (5) Business Days written notice, draw upon the letter of credit (or other form of security) of Generator to obtain payment for such invoice, as well as reasonable costs incurred to exercise its rights under this Section 10. In addition, Georgia Power may, at its option, treat such non-payment as a Default of this Agreement under Section 3.2 hereof.
Failure to Timely Pay. If a claim under this Agreement is not paid by the Company, or on its behalf, within sixty (60) days after a written claim has been received by the Company, the Indemnitee may at any time thereafter bring suit against the Company to recover the unpaid amount of the claim and, if successful in whole or in part, the Indemnitee shall be entitled to be paid also the expense (including reasonable attorney's fees) of prosecuting such claim.

Failure to Timely Pay. If any Party fails to pay amounts under this Base Contract when due and such payment is not remedied within five (5) Business Days after written notice thereof (provided the payment is not subject to good faith dispute as described in Section 7.1.2), in addition to the rights and remedies provided in this Base Contract, the aggrieved Party shall have the right to: (i) suspend performance under this Base Contract until such amounts plus interest at the Interest Rate have been paid, and/or (ii) exercise any remedy available at law or in equity to enforce payment of such amount plus interest at the Interest Rate.
