False Statements; Omissions. Any representation or warranty confirmed or made in any Loan Document by or on behalf of the Borrower, Holdco, the Sponsor, the Investor, the Operator or any Major Project Participant in any certificate, Financial Statement or other document provided by or on behalf of any such Person to DOE, the Agents or any Independent Consultant in connection with the transactions contemplated by the Transaction Documents shall be found to have been false or misleading in any material respect when made or deemed to have been made.
