Common use of FATCA Status Clause in Contracts

FATCA Status. The Administrative Agent and the Lenders shall, solely for purposes of determining the applicability of U.S. Federal withholding Taxes imposed by FATCA, from and after the Second Amendment Effective Date, treat the Credit Agreement (together with any loans or other extensions of credit pursuant thereto) as not qualifying as a “grandfathered obligation” under FATCA.
