Common use of Federal Mining Claim Maintenance Fees Clause in Contracts

Federal Mining Claim Maintenance Fees. If under applicable federal laws and regulations federal annual mining claim maintenance fees are required to be paid for the unpatented mining claims which constitute all or part of the Property, beginning with the annual assessment work period of September 1, 2017, to September 1, 2018, NCG shall pay the federal annual mining claim maintenance fees no later than two (2) months before the applicable statutory and regulatory deadline, and shall execute and record or file, as applicable, proof of payment of the federal annual mining claim maintenance fees and of Owner’s intention to hold the unpatented mining claims which constitute the Property. If NCG elects to terminate this Agreement more than two (2) months before the deadline for payment of the federal annual mining claim maintenance fees for the following annual assessment year, NCG shall have no obligation to pay the federal annual mining claim maintenance fees for the Property for the following assessment year. If NCG does not terminate this Agreement more than two (2) months before the deadline for payment of the federal annual mining claim maintenance fees for the following annual assessment year, NCG shall pay the annual maintenance fees for the Property for the following assessment year.

If NCG Lessee elects to terminate this Agreement more than two (2) months before the deadline for payment of the federal Federal annual mining claim maintenance fees for the following annual assessment year, NCG Lessee shall have no obligation to pay the federal Federal annual mining claim maintenance fees for the Property for the following assessment year. If NCG does not terminate this Agreement more than two (2) months before the deadline Lessee’s obligation for payment of the federal Federal annual mining claim maintenance fees and recording of the proof of payment and notice of intent to hold the claims for the following annual assessment yearwork period September 1, NCG 2004, to September 1, 2005, is an unconditional obligation of Lessee which shall pay the annual maintenance fees for the Property for the following assessment yearsurvive termination of this Agreement.
