Common use of Fifty Two Week Liquidated Damages Amount Clause in Contracts

Fifty Two Week Liquidated Damages Amount. Except as provided in below, the Liquidated Damages (“Liquidated Damages”) amount, if due as provided above, shall be equal to (i) the weekly amount stated as Base Salary then in effect but not less than the weekly Base Salary amount set forth on Exhibit “A”, multiplied by fifty two (52) weeks, plus (ii) an amount equal to the maximum annual performance bonus the Executive could earn as set forth on Exhibit “A” for the year that includes the termination date, determined under the performance based bonus plan in which the Executive is then participating.
