Common use of Filing of Canadian Prospectus Supplement and U.S. Prospectus Supplement Clause in Contracts

Filing of Canadian Prospectus Supplement and U.S. Prospectus Supplement. The Company will use commercially reasonable efforts to (1) as soon as possible and in any event no later than 9:30 a.m. (New York time) on December 14, 2012 (the “Final Filing Time”), prepare and file with each Qualifying Authority the Canadian Prospectus Supplement, and (2) prepare and file with the Commission the U.S. Prospectus Supplement within the time period prescribed by Rule 424 under the 1933 Act;

Filing of Canadian Prospectus Supplement and U.S. Prospectus Supplement. The Company will use commercially reasonable efforts to (1) as soon as possible and in any event no later than 9:30 a.m. (New York time) on December 14September 16, 2012 2009 (the “"Final Filing Time”"), prepare and file with each Qualifying Authority the Canadian Prospectus Supplement, and (2) prepare and file with the Commission the U.S. Prospectus Supplement within the time period prescribed by Rule 424 under the 1933 Act;

Filing of Canadian Prospectus Supplement and U.S. Prospectus Supplement. The Company will use commercially reasonable efforts to (1) as soon as possible and in any event no later than 9:30 a.m. 2:30 p.m. (New York Vancouver time) on December 14August 13, 2012 2014 (the “Final Filing Time”), prepare and file with each Qualifying Canadian Authority the Canadian Prospectus Supplement, and (2) prepare and file with the Commission the U.S. Prospectus Supplement within the time period prescribed by Rule 424 under the 1933 Act;

Filing of Canadian Prospectus Supplement and U.S. Prospectus Supplement. The Company will use commercially reasonable efforts to (1) as soon as possible and in any event no later than 9:30 a.m. 2:30 p.m. (New York Vancouver time) on December 14January 28, 2012 2015 (the “Final Filing Time”), prepare and file with each Qualifying Canadian Authority the Canadian Prospectus Supplement, and (2) prepare and file with the Commission the U.S. Prospectus Supplement within the time period prescribed by Rule 424 under the 1933 Act;
