Final Approval of Final Plans. ACHD shall approve, in its reasonable discretion, the Engineer’s Estimate and the Project plans. ACHD and Developer shall acknowledge in writing the final, approved Project plans and the Engineer’s Estimate prior to commencement of construction, and neither shall thereafter be modified in any material way unless such modifications are approved in writing signed by ACHD and Developer.
