Common use of Financial Information, etc Clause in Contracts

Financial Information, etc. The Lender shall have received (a) audited consolidated financial statements of the Borrower and the Subsidiaries for each of the fiscal years ended December 31, 2010 and December 31, 2011. (b) unaudited consolidated balance sheets of the Borrower and the Subsidiaries for each fiscal quarter ended after January 1, 2012 and prior to January 1, 2013, together with the related consolidated statement of operations, shareholder’s equity and cash flows for the twelve months then ended; and (c) such other financial information as to the Borrower and the Subsidiaries and their respective businesses, assets and liabilities as the Lender may reasonably request.

Financial Information, etc. The Lender shall have received: (a) audited consolidated financial statements of the Borrower and the Subsidiaries for each of the fiscal years ended December 31, 2010 2015, December 31, 2016, and December 31, 2011.2017; (b) unaudited consolidated balance sheets of the Borrower and the Subsidiaries for each fiscal quarter Fiscal Quarter ended after January 1December 31, 2012 and prior to January 1, 20132016, together with the related consolidated statement of operations, shareholder’s equity and cash flows for the twelve months then ended; and (c) such other financial information as to the Borrower and the Subsidiaries and their respective businesses, assets and liabilities as the Lender may reasonably request.

Financial Information, etc. The Lender shall have received (a) audited consolidated financial statements of Holdings, the Borrower and the Subsidiaries for each of the fiscal years ended December 31, 2010 and December 31June 30, 2011, June 30, 2012 and June 30, 2013. (b) unaudited consolidated balance sheets of Holdings, the Borrower and the Subsidiaries for each fiscal quarter ended after January 1, 2012 and prior to January 1June 30, 2013, together with the related consolidated statement of operations, shareholder’s equity and cash flows for the twelve months then endedsuch quarter and fiscal year to date; and (c) such other financial information as to Holdings, the Borrower and the Subsidiaries and their respective businesses, assets and liabilities as the Lender may reasonably request.

(b) unaudited consolidated balance sheets of the Borrower and the Subsidiaries for each fiscal quarter ended after January 1December 31, 2012 and prior to January 1, 20132015, together with the related consolidated statement of operations, shareholder’s equity and cash flows for the twelve months then ended; and (c) such other financial information as to the Borrower and the Subsidiaries and their respective businesses, assets and liabilities as the Lender may reasonably request.

(b) unaudited consolidated balance sheets of the Borrower and the Subsidiaries for each fiscal quarter ended after January 1December 31, 2012 and prior to January 1, 20132017, together with the related consolidated statement of operations, shareholder’s equity and cash flows for the twelve months then ended; and (c) such other financial information as to the Borrower and the Subsidiaries and their respective businesses, assets and liabilities as the Lender may reasonably request.

Financial Information, etc. The Lender shall have received (a) audited consolidated financial statements of Holdings, the Borrower and the Subsidiaries for each of the fiscal years ended December 31, 2010 2010, December 31, 2011 and December 31, 2011.2012; (b) unaudited consolidated balance sheets of Holdings, the Borrower and the Subsidiaries for each fiscal quarter ended after January 1December 31, 2012 and prior up to January 1September 30, 2013, together with the related consolidated statement of operations, shareholder’s equity and cash flows for the twelve months then endedflows; and (c) such other financial information as to Holdings, the Borrower and the Subsidiaries and their respective businesses, assets and liabilities as the Lender may reasonably request.

Financial Information, etc. The Lender shall have received (a) audited consolidated financial statements of Holdings, the Borrower and the Subsidiaries for each of the fiscal years ended December 31, 2009, December 31, 2010 and December 31, 2011.; (b) unaudited consolidated balance sheets of Holdings, the Borrower and the Subsidiaries for each fiscal quarter ended after January 1December 31, 2012 and prior to January 1, 20132011, together with the related consolidated statement of operations, shareholder’s equity and cash flows for the twelve months then ended; and (c) such other financial information as to Holdings, the Borrower and the Subsidiaries and their respective businesses, assets and liabilities as the Lender may reasonably request.

(b) unaudited consolidated balance sheets of the Borrower and the Subsidiaries for each fiscal quarter Fiscal Quarter ended on or after January 1March 31, 2012 and prior to January 1, 20132022, together with the related consolidated statement of operationscomprehensive loss, shareholder’s stockholders’ equity and cash flows for the twelve three months then ended; and (c) such other financial information as to the Borrower and the Subsidiaries and their respective businesses, assets and liabilities as the Lender may reasonably request.
