Common use of Financing and Assignment Clause in Contracts

Financing and Assignment. This Agreement binds Customer, regardless of any financing arrangements, subrogations or assumptions. Customer acknowledges that Xxxx may have a contractual relationship with one or more third-party financing companies, wherein such companies have agreed that to offer financing to Product customers if they meet certain financial criteria. Customer further acknowledges that Xxxx is not a party to any resulting financing agreements which Customer may enter with any third-party financing company. Customer may not assign its rights or delegate its obligations hereunder except with the prior written consent of Xxxx (which may be withheld in its sole discretion). Xxxx may subcontract the performance of any obligation of Xxxx under the Agreement, and Xxxx may assign any right or obligation under the Agreement, to an affiliated party of Xxxx.
