Common use of Financing Statements; Priority of Liens Clause in Contracts

Financing Statements; Priority of Liens. Borrower agrees, at its own expense, to authorize the filing of financing statements, continuation statements and amendments provided for by the Code and to execute and deliver any and all other instruments or documents and take such other action as may be required to perfect and to continue the perfection of Agent’s security interest in the Collateral. Borrower hereby authorizes Agent to execute and/or file on Borrower’s behalf any such financing statements, continuation statements and amendments. Each Lender shall have an equal security interest in the Collateral based upon its Pro Rata Percentage and no Lender’s security interest in the Collateral shall have priority over any other Lender’s security interest in the Collateral.
