First Expansion Premises. (a) Base Rent for the area of the Premises which comprises the First Expansion Space shall commence on October 7, 2014, and shall be due and payable to Landlord by Tenant in monthly installments of $2,398.42 (based on an annual rental amount of $17.00 per square foot) on October 7, 2014, and continuing on the first (1st) day of each month thereafter through February 2016.
First Expansion Premises. From and after the First Expansion Premises Commencement Date, Tenant shall pay Base Rent with respect to the First Expansion Premises, on a per-rentable-square-foot basis, using the applicable monthly rates set forth in the rent schedule contained in Section 5(d) below.
First Expansion Premises. Effective as of the Substantial Completion of the First Expansion Premises Work (as hereinafter defined) (the “First Expansion Date”), Tenant hereby leases from Landlord, and Landlord hereby leases to Tenant, the First Expansion Premises. As used herein, the term “First Expansion Premises” shall mean approximately 16,823 rentable square feet of office space (such space shall be included in the definition of Office Space in the Existing Lease), and approximately 3,279 rentable square feet of research and development space, for a total of 20,102 rentable square feet. The office space portion of the First Expansion Premises is shown on the plan attached hereto as Exhibit A as “Vapotherm 1st Expansion est. 7,735 SF” and
First Expansion Premises. Effective on the full execution and delivery of this First Amendment by Landlord and Tenant (the “First Expansion Effective Date”), the Premises, as defined in the Lease, are increased by the addition of the First Expansion Premises and, except as otherwise specifically provided in this First Amendment, from and after the First Expansion Effective Date, the Original Premises and the First Expansion Premises, shall be deemed the “Premises” for all purposes under the Lease.
First Expansion Premises. The terms of this EXHIBIT D shall apply to the First Expansion Premises and all references to the Commencement Date in this Exhibit as it pertains to the First Expansion Premises shall refer to the First Expansion Premises Commencement Date as set forth in Article XXIV of the Lease.
First Expansion Premises. (a) As of the Effective Date (also referred to herein as the “First Expansion Premises Commencement Date”), Landlord leases and demises the First Expansion Premises to Tenant. As of the Effective Date, the Existing Premises and the First Expansion Premises are collectively referred to herein as the “Premises” and all references to the Premises in the Lease shall be deemed to refer to the Existing Premises and the First Expansion Premises.
First Expansion Premises. (i) for the period commencing on the First Expansion Premises Commencement Date and continuing for sixty (60) days thereafter, Tenant shall not be obligated for the payment of Annual Rent and Occupancy Costs (as further described below) in the First Expansion Premises; and
First Expansion Premises. Work to be performed by Tenant with respect to the First Expansion Premises (the “First Expansion Work”) will be performed in accordance with and subject to the terms of the Work Letter.
First Expansion Premises. In addition to the Original Premises, commencing on the First Expansion Premises Commencement Date (as defined in Section 3 below), Landlord leases to Tenant, and Tenant leases from Landlord, that certain portion of the ground floor of the Building containing approximately 15,116 rentable square feet, as more particularly shown on Exhibit A attached hereto as the Expansion Premises (the “First Expansion Premises”).
First Expansion Premises. Beginning on the First Expansion Premises Rent Commencement Date, Tenant shall commence paying Base Rent for the First Expansion Premises at the rate of $5.05 per rentable square foot of the First Expansion Premises per month, subject to adjustment pursuant to Section 4 of the Lease.
