First Lien Status. Mortgagor shall preserve the first lien and security interest status of this Mortgage; provided that the incurrence of Permitted Encumbrances and Permitted Liens shall not be considered a failure to preserve such first lien and security interest status. If any lien or security interest other than a Permitted Encumbrance or a Permitted Lien is asserted against the Mortgaged Property, Mortgagor shall promptly take such actions required by required by and in compliance with the Credit Agreement.
