Fiscal Year 2012. By giving written notice of its desire to do so on or before October 1, 2010 either party may reopen this Agreement for purposes of negotiating increases in general wages. In accordance with state statute, the Governor’s Budget Recommendation shall include the wage increase negotiated by the parties. Any increases in general wages agreed to shall be subject to legislative appropriation and to impasse resolution procedures mandated by the Public Employee Bargaining Act in effect at the time notice is given. All other terms of this Agreement shall remain in full force and effect. If notice of Agreement Between The State of New Mexico and AFSCME Council 18 desire to reopen the Agreement is not given by either party, then the matter will be considered closed for Fiscal Year 2012.
