Fixed Pricing. All Pooled Equipment shall either have the pricing you pay for the rental or maintenance of that equipment fixed or not, as indicated in this Agreement. If the pricing is fixed, Xerox shall forego any rights it might have pursuant to the Underlying Agreements to increase the amount you pay to rent or maintain the Pooled Equipment throughout the initial termof each Underlying Agreement.

Fixed Pricing. Except for the process described in the “Annual Competitive Review Process” section of this Contract, all prices, terms, warranties and benefits granted by the Supplier in their proposal and this Contract are fixed and stabilized for the term of the Contract, including any extension years.
Fixed Pricing. If prices offered for base models and optional equipment are a fixed price, no price increase will be allowed during the initial term of the Contract. If it is decided to extend the existing Contract, the Contractor will be given the opportunity to review its prices for the next Contract term. Prices may be adjusted, up or down, on the current Contractor’s Price Schedule on an Excel® spreadsheet that will be provided by the State. New equipment models and new options may be added at extension review. Upon receipt of the revised Price Schedule, the State will review the information to determine to either extend or not extend a contract or to rebid, whatever is in the State’s best interest. If requested, the Contractor will provide any documentation needed to validate a price adjustment. For optional items which end up being in lieu of standard items, the price shall be the difference paid to achieve the upgrade rather than full purchase price.
Fixed Pricing. If the Owner elects not to utilize unit pricing, or in the event that unit pricing is not available or appropriate as determined by Owner’s Authorized Representative, fixed pricing may be used for Change Order Work. In fixed pricing the basis of payments or total price shall be agreed upon in writing between the parties to the Contract, and shall be established before the Work is done whenever feasible. The mark-ups set forth in Section 4.A.8.c shall be utilized by the parties as a guide in establishing fixed pricing, and will not be exceeded without adequate justification. Detailed cost and price data relating to fixed pricing shall be supplied by Contractor to Owner upon request, but Owner shall be under no obligation to make such requests.
