a. Price Increase Requests: Commencing with the first anniversary date of the Contract Execution Date, and annually thereafter, the Contractor may request an increase in the pricing contained in Appendix D, Pricing Schedule by submitting an update request based on changes in pricing level as contained in Appendix C, Contract Modification Procedure to the OGS Contract Administrator.
(i) CPI Price Increase: The Contractor may request a rate increase based upon fluctuations in the latest available National Consumer Price Index - All Urban Consumers (CPI-U), Not Seasonally Adjusted, U.S. City Average, All Items (Series Id: CUUR0000SA0, CUUS0000SA0); as published by the U.S. Department of Labor, Bureau of Xxxxx Xxxxxxxxxx, Xxxxxxxxxx, X.X. 00000. CPI-U data may be obtained at xxx.xxx.xxx. The Contractor is solely responsible for notifying OGS Procurement Services that the Contractor wishes to receive the CPI rate change to submit a request for the adjusted rate on the applicable Contract Execution anniversary Date; and Contractor shall provide a copy of the index, a completed Appendix C - Contract Modification Procedure and other supporting documentation necessary to support the increase to OGS Procurement Services. Price adjustments using the CPI involve changing the base payment by the percent change in the level of the CPI for the current year compared to the previous year. This is calculated by first determining the index point change between the two periods and then the percent change. The price adjustment shall be calculated as follows: Take the CPI value for the current period and subtract the CPI value for the previous period. The difference is then divided by the previous period CPI value and this result is then multiplied by 100 to equal the percent change which is the price adjustment value. This percentage change shall be applied to the next Contract year, upon notification from OGS Procurement Services. The following example illustrates the computation of percent change: CPI for current period 185.2 Less CPI for previous period 181.7 Equals index point change 3.5 Divided by previous period CPI 181.7 Equals 0.0192 Result multiplied by 100 0.019 x 100 Equals percent change 1.9 The “CPI for current period” shall be the index in effect at the time the Contract pricelist update ...
Price Increases. Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the supplier and/or government, even after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms.
Price Increases. 5.1 Subject to clause 5.2, we can increase the price of:
(a) the System or any part of it;
(b) the installation of the System; or
(c) any other item specified in the Quote, to cover any new or increased cost in selling and installing the System under this agreement.
5.2 We can only increase prices under clause 5.1 if:
(a) it is reasonable to do so;
(b) we are not prohibited by law from doing so; and
(c) we give you written notice of the increase at least one week before the Target Date set out in the Quote, or, if we have notified you of a new Target Date under clause 7.6, that new Target Date.
5.3 If we give you notice of a price increase and you prefer to end this agreement rather than accept the price increase, you can end the agreement in accordance with clause 5.4 and, if you do, we will give you any refund required under clause 4.1(b).
5.4 You can end this agreement under clause 5.3 by:
(a) calling us on our telephone number as set out in the Quote; or
(b) giving us written notice of this, by post or email, before the Target Date set out in the Quote, or, if we have notified you of a new Target Date under clause 7.6, that new Target Date.
5.5 If we send you notice of a price increase and you do not end this agreement under clause 5.3 by the relevant date, you will be taken to have agreed to the price increase.
Price Increases. DFMC may make a determination during the Term to increase the Minimum Milk Prices (Price Increase). If DFMC makes such a determination, it will give written notice to you of the details of the Price Increase. Due to the requirements of the Dairy Code, in order to be eligible to receive the Price Increase, you will need to agree in writing to the variation of this Contract in accordance with the Price Increase notified to you by DFMC. DFMC will provide you with instructions as to how to agree to any such variation of this Contract at the time it notifies you of the Price Increase.
Price Increases. Pricing may not increase greater than 3% over a single calendar year, and increases must be approved by the Consortium Contract Administrator prior to taking effect.
Price Increases. 6.2.1.1. Contractor may request an increase in the prices listed in Exhibit C by submitting its request to the State in writing as described in §17 of the main body of this Contract. Requests for increases in prices are limited as follows:
6.2.1.1.1. Contractor may not request a price increase during the first 12 months of this Contract.
6.2.1.1.2. Contractor may not request a price increase within any 12-month period following the State’s approval of a price increase under this section.
6.2.1.1.3. Contractor may not submit a request for a price increase to the State fewer than 60 days prior to when Contractor intends those increased prices to be effective.
6.2.1.1.4. Contractor may only request a price increase if it can justify that increase based on the Producer Price Index or the Consumer Price Index issued by the US Department of Labor, Bureau of Labor Statistics; or a similar industry pricing guide.
6.2.1.2. The State may approve or deny any request for a price increase based on the information provided by Contractor and other circumstances in its sole discretion.
6.2.1.3. If the State approves a price increase, that price increase shall not take effect unless it is included in this Contract. The State may increase the prices in Exhibit E through the use of an Option Letter.
6.2.1.3.1. Contractor may only begin using the increased prices in Orders that are issued following the effective date of the modification that increases the prices. For Orders placed prior to a price increase that are in effect at the time of the price increase, Contractor shall only charge the Purchasing Entity the prices that were in effect at the time the Order was placed.
6.2.1.4. If the State does not approve a price increase, or Contractor increases its prices without submitting a request to the State, then those increased prices shall be void in any Order in which they are used and Contractor shall fulfill the Order at the existing rates approved by the State under this Contract. Contractor’s use of rates in any Order that exceed those approved by the State under this Contract shall be a material breach of this Contract.
Price Increases. Contractor may request an increase in the prices listed in Exhibit B by submitting its request to the State in writing as described in §17 of the main body of this Contract. Requests for increases in prices are limited as follows:
a) Contractor may not request a price increase during the Initial Term of this Contract.
b) Contractor may not request a price increase within any twelve (12) month period following the State’s approval of a price increase under this section.
c) Contractor may not submit a request for a price increase to the State fewer than thirty (30) days prior to when Contractor intends those increased prices to be effective.
d) Contractor may only request a price increase if it can justify that increase based on the Producer Price Index or the Consumer Price Index issued by the US Department of Labor, Bureau of Labor Statistics, or a similar industry-pricing guide.
Price Increases. DECREASES: No price increases will be permitted during the term of the Contract. All price decreases will automatically be extended to County.
Price Increases. After the Firm Price Period, Contractor may request price increases. The request shall: include copies of the new price lists or catalog that reflect a change in the Contractor’s cost; not constitute an increase in profit; and apply to all of the Contractor's customers.
