Common use of Flood Hazard Areas Clause in Contracts

Flood Hazard Areas. Except as otherwise identified on the survey delivered pursuant to Section 4.1(i), no portion of the Facility is located in an area identified as a special flood hazard area by the Federal Emergency Management Agency or other applicable agency. If the Facility or any part thereof is located in an area identified as a special flood hazard area by the Federal Emergency Management Agency or other applicable agency, then flood insurance has been obtained for the Facility in accordance with the Lease and in accordance with the National Flood Insurance Act of 1968, as amended.

Flood Hazard Areas. Except as otherwise identified on the ------------------ applicable survey delivered pursuant to Section 4.1(i6.1(m), no portion of the Facility ------------- Property is located in an area identified as a special flood hazard area by the Federal Emergency Management Agency or other applicable agency. If the Facility or any part thereof of the Property is located in an area identified as a special flood hazard area by the Federal Emergency Management Agency or other applicable agency, then flood insurance has been obtained arranged for by the Construction Agent on behalf of the Lessor for the Facility in accordance with the Lease and Property in accordance with the National Flood Insurance Act of 1968, as amended.

Except as otherwise identified on the applicable survey delivered pursuant to Section 4.1(i3.3(b), no portion of the any Facility Site is located in an area identified as a special flood hazard area by the Federal Emergency Management Agency or other applicable agency. If the any Facility or any part thereof Site is located in an area identified as a special flood hazard area by the Federal Emergency Management Agency or other applicable agency, then flood insurance has been obtained for the such Facility Site in accordance with the Master Lease and in accordance with the National Flood Insurance Act of 1968, as amended.

Except as otherwise identified on the survey delivered pursuant to Section 4.1(i4.1(k), no portion of the Facility Properties is located in an area identified as a special flood hazard area by the Federal Emergency Management Agency or other applicable agency. If the Facility or any part thereof either Property is located in an area identified as a special flood hazard area by the Federal Emergency Management Agency or other applicable agency, then flood insurance has been obtained for the Facility Properties in accordance with the Lease and in accordance with the National Flood Insurance Act of 1968, as amended.
