Common use of Flood Hazard Areas Clause in Contracts

Flood Hazard Areas. No portion of the Leased Property is located in an area identified as a special flood hazard area by the Federal Emergency Management Agency or other applicable Governmental Authority. If the Leased Property is located in an area identified as a special flood hazard area by the Federal Emergency Management Agency or other applicable Governmental Authority, then, to the extent required by Applicable Laws, flood insurance has been obtained by Lessee in accordance with the National Flood Insurance Act of 1968, as amended.

No Except as otherwise identified on the applicable survey delivered pursuant to SECTION 2.1(q), no portion of the Leased any Property is located in an area identified as a special flood hazard area by the Federal Emergency Management Agency or other applicable Governmental Authorityagency. If the Leased any Property is located in an area identified as a special flood hazard area by the Federal Emergency Management Agency or other applicable Governmental Authorityagency, then, to the extent required by Applicable Laws, then flood insurance has been obtained by Lessee for such Property in accordance with ARTICLE XIII of the Lease and in accordance with the National Flood Insurance Act of 1968, as amended.
