Flowage Easement Clause Samples
A Flowage Easement is a legal right granted to allow water to flow over, across, or accumulate on a specific parcel of land, typically for flood control or water management purposes. In practice, this easement permits a government agency or utility to temporarily inundate private property during periods of high water, such as after heavy rainfall or dam releases, without being liable for damages caused by the flooding. The core function of a flowage easement is to facilitate effective water management and flood mitigation while clearly defining the rights and limitations of both the property owner and the easement holder, thereby reducing disputes and allocating risk.
