Common use of Following First NDA Approval Clause in Contracts

Following First NDA Approval. The following procedure in this subsection (d) will apply after the first NDA approval for a Product, unless otherwise agreed by the JDC. Within thirty (30) days after the end of each Calendar Quarter in which FibroGen conducts activities under the Development Plan, FibroGen shall send to AstraZeneca an invoice for all Development Costs incurred by FibroGen in such Calendar Quarter, up to an amount equal to [ * ] percent ([ * ]%) of the budgeted amount for the applicable activities. AstraZeneca shall pay each such invoice within forty-five (45) days after receipt thereof.
