Common use of For Disability Clause in Contracts

For Disability. The Company may, upon ninety (90) days prior written notice, terminate Employee's employment after having established the Employee's Disability. For purposes of this Agreement, "Disability" means a physical or mental infirmity which impairs the Employee's ability to substantially perform his duties pursuant to this Agreement which infirmity continues for a period of at least 120 days in any 365 day period. Upon termination for disability, the Company shall continue to pay Employee all salary and benefits hereunder for the remainder of the Term, less any disability insurance payments received by Employee.

For purposes of this Agreement, "Disability" means a physical or mental infirmity as a result of which impairs the Employee's ability to substantially perform his duties pursuant to this Agreement which infirmity continues Employee remains absent from work for a period of at least two (2) successive months, or an aggregate of 120 days in any 365 day twelve (12) month period. Upon termination for disability, the Company shall continue to pay Employee all salary and benefits hereunder for the remainder of the Term, less any disability insurance payments received by Employee.
