Common use of Force Account Clause in Contracts

Force Account. The Change Order cost is accomplished by Force Account in the event the Contractor and Design Professional cannot agree on the cost of the Change Order or the cost cannot be reasonably determined prior to beginning the Work. 3.2.7.3.1 A Force Account is the establishment by the Owner’s Incumbrance Record of a maximum dollar amount (Stipulated Maximum Sum) beyond which no changed work may be undertaken, subject to amendment, for funding all costs of a Change Order. As the Work authorized by the Change Order progresses, the Contractor must provide an accounting of actual costs incurred in accomplishing the Work.
