Common use of Force Adjustment Plan Clause in Contracts

Force Adjustment Plan. A surplus condition may be declared by the Company in a job title and Involuntary Transfer Area. The Company shall notify the Union in writing of any declared surplus condition and shall provide the Union with the job title and Involuntary Transfer Area affected, together with the names, titles, net credited service dates, and work locations of all employees in the affected job title and Involuntary Transfer Area. The Company shall also notify the Union in writing whether the surplus condition is caused by Process Change or by an External Event as those terms are defined in a letter of agreement. If the surplus is caused by Process Change, the provisions of paragraphs 15.06(b) and 15.08 shall not apply. If the surplus is caused by an External Event, the Company may implement paragraphs 15.06(b) and 15.08. Thereafter, the Company shall take the following steps, in the order indicated below, in each case to the extent necessary to eliminate the surplus.

The Company shall also notify the Union in writing whether the surplus condition is caused by Process Change or by an External Event as those terms are defined in a the letter of agreementagreement dated April 3, 1994. If the surplus condition is caused by Process Change, the provisions pro- visions of paragraphs 15.06(b33.08(b) and 15.08 33.10 shall not applybe implemented. If the surplus is caused by an External Event, the Company may implement paragraphs 15.06(b33.08 (b) and 15.0833.10. Thereafter, the Company shall take the following steps, in the order indicated indi- cated below, in each case to the extent necessary to eliminate the surplussurplus condition.
