Common use of Force Majeure Duration Clause in Contracts

Force Majeure Duration. Notwithstanding the foregoing, if a Party is prevented from substantially performing its obligations under this AGREEMENT for a period of two (2) years due to the occurrence of a Force Majeure event, the other Party may elect to terminate this AGREEMENT by ninety (90) days written notice given any time thereafter to the non-performing Party, unless substantial performance is resumed prior to the expiration of such ninety (90) day period; provided that the Buyer shall not elect to terminate this AGREEMENT under this part due to a Force Majeure event described in Article (6).
