Force Majeure Event Defined. In this Funding Agreement, a Force Majeure Event means any event or circumstance or combination of events or circumstances occurring after the Commencement Date: that is not within the reasonable control, contemplation or foresight of the Recipient; the occurrence or effect of which the Recipient could not have avoided through compliance with its obligations under this Funding Agreement and the exercise of reasonable care and conducting its activities in accordance with Good Electricity Industry Practice or Good Industry Practice; and that causes or results in the prevention or delay of the Recipient from performing its obligations under this Funding Agreement,
Force Majeure Event Defined. Force Majeure Event shall mean any event or circumstance or a combination of events and circumstances (occurring in India) set out hereunder or the consequence(s) thereof which affect or prevent the Party (Grantor or Authorisee) claiming Force Majeure ("Affected Party") from performing its obligations in whole or in part under this Agreement and which event or circumstance which is (a) is beyond the reasonable control of the Affected Party, (b) such party could not have prevented or reasonably overcome with the exercise of due diligence, reasonable efforts, skill and care, (c) does not result from the negligence of such party or the failure of such party to perform its obligations hereunder, (d) is of an incapacitating nature and prevents or causes a delay or impediment in performance that has Material Adverse Effect and (e) is all or any of the following circumstances:
Force Majeure Event Defined. As used in this Agreement, “Force Majeure Event” means, causes or events that are beyond the reasonable control of, and without the fault or negligence of, the Party claiming such Force Majeure Event, including, without limitation, natural disasters; fire; lightening strikes; earthquake; unavailability of equipment; acts of God; severe actions of the elements such as snow, floods, hurricanes, high winds or tornadoes; causes or events affecting the performance of third-party suppliers of goods or services to the extent caused by an event that otherwise is a Force Majeure Event under this Section 6.1; sabotage; terrorism; war; riots or public disorders; strikes or other labor disputes; and actions or failures to act (including expropriation and requisition) of any governmental agency, to the extent such cause or event prevents or delays performance of any obligation imposed on the Party claiming such Force Majeure Event (other than an obligation to pay money).

Force Majeure Event Defined. Force Majeure Event" means any event not within the control of the affected Party and which, by the exercise of due diligence, such Party is unable to prevent or overcome, including any act of God, strike, lockout, or other industrial disturbance, act of the public enemy, sabotage, war (whether or not an actual declaration is made thereof), blockade, insurrection, riot, epidemic, landslide, lightning, earthquake, flood, storm, fire, washout, arrest and restraint of rulers and peoples, civil disturbance, explosion, the act of any court or governmental authority, or any other such cause.
Force Majeure Event Defined. As used herein, "Force Majeure Event" shall mean any act, omission or circumstance, including, without limitation, any event or circumstances occasioned by or resulting from any acts of God, acts of the public enemy, wars, blockades, insurrections, riots, epidemics, landslides, lightning, earthquakes, tornadoes, windstorms, volcanoes, fires, storms, floods, disasters, civil disturbances, explosions, sabotage, Governmental Actions, the failure to act of any Governmental Authority, the inability to obtain, maintain or renew any Applicable Permits, changes in Applicable Laws, shortages of labor or materials, strikes or other labor disputes, failures or partial failures of any Equipment, failure of transportation which, in each case, is not within the commercially reasonable control of a party hereto, is not due to a Local Political Risk Event, and wholly or partially prevents or delays such party from performing its obligations hereunder; provided, however, that "Force Majeure Event" shall not include an act, omission or circumstance arising from the Fault or Breach of, or economic hardship affecting, the party claiming that a Force Majeure Event has occurred.
