Common use of Foreign Plan Clause in Contracts

Foreign Plan. Foreign Plan" shall mean any employee benefit plan covering employees or former employees of any Subsidiary of Harveys or any ERISA Affiliate which is organized under the laws of any country other than the U.S. (with respect to such employees' relationship with such entities) which if maintained or administered in or otherwise subject to the laws of the United States would constitute a Pension Plan, a Multiemployer Plan or Welfare Plan.
