Common use of Fractions of Units Clause in Contracts

Fractions of Units. The Company may, but shall not be required to, issue a fraction of a Warrant Interest upon the exercise of this Warrant in whole or in part. As to any fraction of a unit which the Company elects not to issue, the Company shall make a cash payment in respect of such fraction in an amount equal to the same fraction of the Fair Market Value of a Warrant Interest on the date of such exercise.
