Framework service providers. 9.1. The Service Provider acknowledges that this is a framework Contract for the provision of the Services and that the scope of the required Services and the terms for their performance shall be determined by the IAA, from time to time, according to its needs and at its sole discretion.
9.2. The Service Provider is aware that the IAA has entered into this framework Contract with several others who were declared as Awarded Bidders in the Tender (the “Framework Service Providers”), and that the IAA shall be entitled to procure Services from any of these Framework Service Providers in accordance with the Bidding process, as further specified in section 10 below.
9.3. The Framework Service Providers selected under the Tender will not be ranked in any particular order and the allocation of work between them shall be done in a random order, based on the results of the Bidding process. The scope and/or terms of the Work Order and the Services that will be required from any of the Framework Service Providers may or may not be equivalent or comparable, and the IAA makes no commitments in this regard. Not only this, but there may also be major differences in the type of Services, timing, the required expertise and the consideration paid for the Services under any particular Work Order.
9.4. The signature of this Contract by itself does not grant the Service Provider an inherent right to perform certain Services or the award of a Work Order (if any) and/or to receive any payment from the IAA. Without derogating from the above it is expressly clarified, that the Service Provider hereby waives and shall be prevented from raising any claim and/or demand against the IAA regarding the scope and/or terms of the Work Orders issued and the Services required of the Service Provider and each of the other Framework Service Providers.
9.5. The IAA shall be entitled to cancel the award of a Work Order of any Framework Service Provider if it believes that despite any previous statements, such Framework Service Provider is lacking the required expertise.
