Fraudulent Impressions. Any method to artificially and/or fraudulently inflates the volume of impressions or clicks is strictly forbidden. Counts of impressions or clicks will be decided solely on the basis of reports generated by AdRight Advertising Network. These prohibited methods include but are not limited to: Bots and Malware, domain masking, click fraud, conversion fraud, running AdRight’s Advertising Material / Javascript tag in hidden iframes, framing an ad-banner’s click-through destination, auto-spawning of browsers, running ‘spiders’ against the Publisher’s own Website, automatic redirecting of users or any other technique of generating automatic or fraudulent (as determined by AdRight, acting reasonably, or based on industry practices) click-through and/or impressions. Advertising Material may not be placed on a page which reloads automatically. Publisher may not require users to click on Advertising Material prior to entering a Website or any area therein or provide incentives of any nature to encourage or require users to click on Advertising Material. Publisher’s clicks- throughs of any link other than AdRight’s Advertising Material, or use of any other means of artificially enhancing click results shall be a material breach of this Agreement, and upon such occurrence, AdRight may terminate this Agreement without prior notification. Such termination is at the sole discretion of AdRight and is not in lieu of any other remedy available at law or equity. AdRight’s ad server will be the official counter for determining the number of Advertising Material delivered under and amounts payable under this Agreement. For each case of intentional or negligent violation of the present provisions, the Publisher hereby undertakes to pay AdRight liquidated damages in each case in an amount to be determined at AdRight’ s equitably exercised discretion and, in the event of dispute, in an amount to be reviewed by court. Each instance of violation shall be subject to liquidated damages in the maximum amount of the current balance of the Publisher Account.

These prohibited methods include but are not limited to: framing an ad-banner’s click-through destination, auto-spawning of browsers, running “spiders” against the Publisher’s own Website, automatic redirecting of users, or any other technique of generating automatic or fraudulent (as determined by Redpath Media, acting reasonably, or based on industry practices) click-through or impressions. Advertising Material must not be placed on a page that reloads automatically. Publisher must not require users to click on Advertising Material before entering a Website or any area in a Website or provide incentives of any nature to encourage or require users to click on Advertising Material. Publisher’s clicks-throughs of any link other than Redpath Media’s Advertising Material or use of any other means of artificially enhancing click results will be a material breach of this agreement, and on that occurrence, Redpath Media may terminate this agreement without prior notice. That termination is at Redpath Media’s sole discretion and is not instead of any other remedy available at law or equity.

  • Fraudulent Claims If any claim under this Agreement is in any respect fraudulent, all benefits payable and/or paid in relation to that claim shall be forfeited and if deemed appropriate, recoverable, respectively.

  • FRAUDULENT TRANSACTIONS 1. If the Cardmember commits or attempts to commit any fraudulent transaction of any nature as determined by AEME, or applicable laws, AEME has the right to immediately cancel the Card in addition to any other legal action available by law. The Cardmember shall be fully liable for all amounts and damages of any nature that AEME, Service Establishments or third parties may sustain because of his or her fraudulent acts. AEME shall have the right to and is hereby authorized to file complaints and reports on behalf of the Cardmember and to provide information about the Card, Account or Transactions to any competent court, or regulatory or government authority and to participate in any investigation of fraud. 2. If the Cardmember uses his or her Card in compliance with the provisions of this Agreement to pay for goods or services offered online over the internet on websites which display the “Online Fraud Protection Guarantee” logo, the Cardmember shall not be liable for any fraudulent Unauthorized Transaction made on his or her Card unless the Cardmember fails to notify AEME of such fraudulent Transaction within 30 days from the date of receipt of the Statement of Account where such fraudulent Transaction appears.
