Common use of FREQUENCY AUTHORISATION Clause in Contracts

FREQUENCY AUTHORISATION. 36.1 A separate specific authorization and licence (hereinafter called WPC licence) shall be required from the WPC wing of the Department of Telecommunications, Ministry of Communications permitting utilization of appropriate frequencies / band for the establishment and possession and operation of Wireless element of the Telecom Service under the Licence Agreement of Internet Service under specified terms and conditions including payment for said authorization & WPC licence. Such grant of authorization & WPC licence will be governed by normal rules, procedures and guidelines and will be subject to completion of necessary formalities therein. 36.2 For this purpose, a separate application shall be made to the “Wireless Advisor to the Government of India, WPC Wing, Department of Telecommunications, Ministry of Communications, Sanchar Bhawan, New Delhi-110 001” in a prescribed application form available from WPC Wing. 36.3 The clearance in respect of fixed stations and its antenna mast shall be obtained from the WPC Wing for which the applicant shall separately apply to the Secretary, Standing Advisory Committee on Frequency Allocations (SACFA) WPC Wing in a prescribed application form, to the following address: The Secretary (SACFA), WPC Wing, Ministry of Communications, Department of Telecommunications, Sanchar Bhawan, New Delhi-110 001. EXPLANATION: SACFA is the apex body in the Ministry of Communications for considering matters regarding coordination for frequency allocations and other related issues / matters. (Siting clearance refers to the agreement of major wireless users for location of proposed fixed antenna from the point of view of compatibility with other radio systems and aviation hazard. It requires inter departmental coordination and is an involved process). Normally the siting clearance procedure may take two to six months depending on the nature of the installations and the height of the antenna /masts. 36.4 The LICENSEE shall not cause or allow to cause harmful interference to other authorized users of radio spectrum. For elimination of harmful interference to other users , LICENSEE shall abide by all instructions and orders issued by the Government. 36.5 The LICENSOR / Wireless Planning and Coordination Wing (WPC) / TRAI shall have the right to inspect from time to time the installations from technical angles to check conformity with Licence Authorising Spectrum Uses. 36.6 In case of provision of band width by the LICENSEE through the Satellite media, the LICENSEE shall abide by the prevalent Government orders, regulation or direction on the subject like Satellite communication policy, VSAT policy etc. 36.7 For use of space segment and setting up and operationalisation of Earth Station etc., LICENSEE shall coordinate with and obtain clearance from Network Operations Control Centre (NOCC), apart from obtaining SACFA clearance and clearance from other authorities. Mere indication of the installations from technical angles band does not guarantee availability of the frequency spectrum, which has to check conformity with Licence Authorising Spectrum Usesbe coordinated on case to case basis. 36.6 In 43.5 Subject to availability and as per Guidelines issued from time to time, the spectrum allocation and frequency bands will be as follows : (i) For wireless operations in SUBSCRIBER access network, the frequencies shall be assigned by WPC wing of the Department of Telecom from the frequency bands earmarked in the applicable National Frequency Allocation Plan and in coordination with various users. Initially a cumulative maximum of upto 4.4 MHz + 4.4 MHz shall be allocated in the case of provision TDMA based systems @ ▇▇▇ ▇▇▇ per carrier or 30 KHz per carrier or a maximum of band width 2.5 MHz + 2.5 MHz shall be allocated in the case of CDMA based systems @ 1.25 MHz per carrier, on case by case basis subject to availability. While efforts would be made to make available larger chunks to the LICENSEE through the Satellite mediaextent feasible, the LICENSEE shall abide by frequencies assigned may not be contiguous and may not be the prevalent Government orders, regulation same in all cases or direction on within the subject like Satellite communication policy, VSAT policy etc. 36.7 whole Service Area. EXPLANATIONNote : SACFA is the apex body in the Ministry of Communications for considering matters regarding coordination for frequency allocations and other related issues / matters. However, the frequency in GSM band of 890-915 MHz paired with 935-960 MHz and 1710-1785 MHz paired with 1805-1880 MHz will not be allocated under any circumstances to the LICENSEE. For Wireless Access Systems in local area, not more than 5+5 MHz in ▇▇▇ - ▇▇▇ ▇▇▇ paired with 869 - 889 MHz band shall be allocated to any Basic Service OPERATOR including the existing ones on first come first served basis.. The same principle shall be followed for allocation of frequency in 1880 - 1900 MHz band for Micro cellular architect based system. The detailed procedure for Wireless Access System frequency allocation linked with roll out obligations, is enclosed as ANNEXURE-IX. 32.6 The LICENSEE shall not cause or allow to cause harmful interference to other authorized users of radio spectrum. For LICENSEE shall abide by any instructions of the Government for elimination of harmful interference to other users , LICENSEE shall abide by all instructions and orders issued by the Governmentauthorized users. 36.5 32.7 The LICENSOR / Wireless Planning and Coordination Wing (WPC) / TRAI shall have the right to inspect from time to time the installations from technical angles to check conformity with Licence Authorising Spectrum UsesWPC Wing’s licence. 36.6 32.8 In case of provision of band width by the LICENSEE through the Satellite media, the LICENSEE shall abide by the prevalent Government orders, regulation or direction on the subject like Satellite communication policy, VSAT V SAT policy etc. 36.7 32.9 For use of space segment and setting up and operationalisation of Earth Station etc., LICENSEE shall directly coordinate with and obtain clearance from Network Operations and Control Centre (NOCC), apart from obtaining SACFA clearance and clearance from other authorities.
