Common use of Frequency of Requests Clause in Contracts

Frequency of Requests. Fund shall not request transaction information more frequently than quarterly, unless good cause justification is demonstrated by the Fund that a more frequent request is necessary to enforce the Fund’s restrictions on market timing and similar abusive transactions. If good cause is not demonstrated, the Fund shall pay the reasonable expenses incurred by the Intermediary in directly complying with the request.
