Fund Distribution. Conduct an annual volunteer citizens’ review (Citizen Review Committee) fund distribution process. Participating agencies shall be eligible to apply for program grants and receive campaign funds during this process. Maintain responsible stewardship on behalf of contributors, participating agencies and the community at large by making community investment grant information available to the public.

Such withdrawals shall be at a valuation based upon the net asset value of the Fund as of the end of the month immediately prior to such withdrawal; provided that no unamortized organizational costs of the Fund will be deducted from amounts required to be distributed to the Investor and ▇▇▇▇▇▇▇▇ ▇▇▇▇▇▇▇ pursuant to this Section 2.5(a).
(b) Notwithstanding anything to the contrary in the Fund Agreement and/or the GP Agreement, on or subsequent to the date on which the Investor receives its $9 million distribution pursuant to Section 2.5(a) above, DLC GP shall be permitted to (i) withdraw an amount equal to the entire portion of its capital account balance attributable to DLM’s investment in DLC GP, and (ii) distribute such amount to DLM. Any unamortized organizational costs of the Fund shall be allocated between DLC GP and the Investor (in respect of the Investor’s remaining capital account balance after its withdrawal from its capital account pursuant to Section 2.5(a) above) in the manner set forth in the Fund Agreement.

(iii) Notwithstanding the above, however, if any claims for indemnification under the Agreement (of which the Stockholder and the Escrow Agent have received an Indemnification Notice on or before the Distribution Date or which were identified in the Distribution Report) remain pending on the Distribution Date, and the amount reflected in either such notice has not been paid to UNITED FINANCIAL/FIRST SECURITY THIRD AMENDMENT Holding Company, then the Escrow Agent shall withhold in the Escrow Fund an amount equal to such pending claims.
(iv) Subject to Section 7 hereof, all amounts in the Escrow Fund on the Distribution Date in excess of such pending claims shall be immediately distributed to the Stockholder.
(v) For purposes of determining the number of Shares to be delivered to the Stockholder or retained in the Escrow Fund following the Distribution Date, all Shares held in the Escrow Fund shall be valued as provided in Section 5.

The County shall distribute funds received under CDBG Act and the HOME Act for fiscal years 2016/17 and 2017/18 or the forty-third, and forty-fourth program years for the undertaking of essential community development and housing assistance activities throughout the Urban County. This will be signed off at the first available Philanthropy and Grants Committee meeting after the service plan submission which will normally be within 6 weeks but no later than 31st December. MKCF will provide written approval of the fund allocation for the following year by the 7th January. The work plan is already agreed with MKC for the financial year 2020/2021. From 2021/2022 onwards, access to the funds is via the production of an annual service plan which evidences the work carried out in the previous year and forward plans that met the criteria of the fund.
