Common use of Funding Request Clause in Contracts

Funding Request. Each of the Agent and the Certificate Holders shall have received a fully executed counterpart of the applicable Funding Request, executed by the Lessee, in accordance with Section 3(c). Each of the delivery of a Funding Request and the acceptance by the Lessee of the proceeds of such Advance shall constitute a representation and warranty by the Lessee that on the applicable Funding Date (both immediately before and after giving effect to the making of such Advance and the application of the proceeds thereof), the statements made in Section 8 are true and correct.

Each of the Agent Agent, the Lenders and the Certificate Holders Lessor shall have received a fully executed counterpart of the applicable Funding Request, executed by the Lessee, in accordance with Section 3(c)4.
