Funds Available and Authorized; Payments. The Resource Provider shall not be compensated for Services performed under this Agreement by any other agency or department of the state of Oregon. The State certifies that it has sufficient funds currently authorized for expenditure to finance the costs of this Agreement within the State’s current biennial appropriation or limitation. The Resource Provider understands and agrees that the State’s payment of amounts under this Agreement is contingent on the State receiving appropriations, limitations, allotments or other expenditure authority sufficient to allow the State, in the exercise of its reasonable administrative discretion, to make payments under this Agreement. Nothing in this Agreement is to be construed as permitting any violation of Article XI, section 7 of the Oregon Constitution or any other law regulating liabilities or monetary obligations of the State of Oregon.
