Funds Subject to Withdrawal Penalties. If any Trust Property cannot be made available for immediate distribution as contemplated hereby without penalty, the Trustee shall promptly so notify the Company. The Trustee shall take such action, if any, as may be required to make the Trust Property available for immediate distribution by the date contemplated by the notice delivered in accordance with the terms hereof unless, within ten (10) Business Days prior to the anticipated date of disbursement, the Company and the Representative give joint written instructions to the contrary. If such instructions are given, the Trustee will follow such instructions.
