Fungus. Fungus(i) includes but is not limited to any plants or organisms belonging to the major group fungi lacking chlorophyll and including moulds rusts mildews and mushrooms.

Fungus. “Fungus” or “fungi” shall mean any type or form of fungus, including mold, mildew, mycotoxins, spores, scents or byproducts produced or released by fungi. Fungi are common, abundant, and an essential part of the world's ecological system. Fungi are found nearly everywhere. Fungi spores are airborne and travel into and out of buildings as air is exchanged and with the movement of people and their belongings. The removal or remediation of any type of fungi, the repair, rebuilding and replacement of any building components or property in any way affected by any type of fungi, the associated cost or expense due to loss of use or interference caused by the removal, remediation, repair or replacement of building components or property due to any type of fungi and the effects, if any, of fungi on people or property, regardless of the cause of the fungi, are specifically excluded from this Limited Warranty.
Fungus. Except as provided in Limited Mold Coverage, we do not cover bodily injury, property damage or personal injury which arises from or in connection with the actual, alleged or threatened discharge, dispersal, release or migration, whether directly or indirectly, of any fungus, whether combined with, or caused by water. This includes: a. a request, order or requirement to test for, monitor, xxxxx, mitigate, remediate, contain, remove, dispose of, or in any way respond to or assess the effects of any fungus; any supervision, instruction, disclosure, failure to disclose, recommendation, warning or advice given or which allegedly should have been given, in connection with any fungus; b. all costs, expenses or damages arising out of any order, claim, suit or threat of liability by or on behalf of a governmental authority or any other person or entity for injury, damages or injunctive relief because of or arising out of contamination or for remediation; or SAMPLE POLICY c. sums an insured is required to expend in equity for or relief from bodily injury, property damage or personal injury. We do cover bodily injury, property damage, or personal injury caused by heat, smoke or fumes from a hostile fire.
Fungus. The CK and all the material that composes the CK shall be impervious to fungus growth.

  • Mold The Contractor shall take steps to prevent mold from developing on the Site, or being released into the air and shall promptly decontaminate any areas of mold that develop.

  • Asbestos Any material that contains more than one percent asbestos and is friable or is releasing asbestos fibers into the air above current action levels established by the United States Occupational Safety and Health Administration.

  • TOXIC SUBSTANCES Each Contractor furnishing a toxic substance as defined by Section 875 of the Labor Law, shall provide such Authorized User with not less than two copies of a material safety data sheet, which sheet shall include for each such substance the information outlined in Section 876 of the Labor Law. Before any chemical product is used or applied on or in any building, a copy of the product label and Material Safety Data Sheet must be provided to and approved by the Authorized User agency representative.

  • Chemical Substances Supplier warrants that: (i) each chemical substance contained in Products is on the inventory of chemical substances compiled and published by the Environmental Protection Agency pursuant to the Toxic Substances Control Act and (ii) all Material Safety Data Sheets required to be provided by Supplier for Products shall be provided to DXC prior to shipment of the Products and shall be complete and accurate.

  • Explosives Explosives or other highly flammable substances shall not be stored or used on Railroad's property without the prior written approval of Railroad.

  • Contamination The presence in, on or under land, air or water of a substance (whether a solid, liquid, gas, odour, heat, sound, vibration or radiation) at a concentration above the concentration at which the substance is normally present in, on or under land, air or water in the same locality, that presents a risk of Environmental Harm, including harm to human health or any other aspect of the Environment, or could otherwise give rise to a risk of non-compliance with any Statutory Requirement for the protection of the Environment.

  • Hazardous Wastes In the event that the Mortgaged Property, related to a Mortgage Loan which is being considered for liquidation by foreclosure or the transfer of a deed-in-lieu of foreclosure, contains, and the Servicer has reason to believe that it contains, hazardous or regulated substances which may impose liability, for damages, remediation or otherwise, upon the owner of such Mortgaged Property pursuant to Federal, State or local law, the Servicer shall not, except with the express prior written approval of the Master Servicer, which approval makes specific reference to the presence of such hazardous or regulated substances, undertake or continue the process of foreclosure with respect to such Mortgaged Property.

  • ENDANGERED SPECIES The Endangered Species Act of 1973 (16 U.S.C. § 1531, et seq.) as amended, particularly section 7 (16 U.S.C. § 1536).

  • Dangerous Materials Tenant shall not keep or have on the Premises any article or thing of a dangerous, flammable, or explosive character that might substantially increase the danger of fire on the Premises, or that might be considered hazardous by a responsible insurance company, unless the prior written consent of Landlord is obtained and proof of adequate insurance protection is provided by Tenant to Landlord.
