Furnishing of Documents; and Representations and Warranties of Trust. 2.1 The following documents, including any amendments thereto, will be provided contemporaneously with the execution of the Agreement, to the Custodian by the Trust: 1) A copy of the Declaration of Trust of the Trust certified by the Secretary. 2) A copy of the By-Laws of the Trust certified by the Secretary. 3) A copy of the resolution of the Board of Trustees of the Trust appointing the Custodian, certified by the Secretary. 4) A copy of the then current Prospectuses. 5) A Certificate of the President and Secretary of the Trust setting forth the names and signatures of all Authorized Persons. In addition, the Trust agrees to notify the Custodian in writing of the appointment, termination or change in appointment of any Dividend and Transfer Agent.
