Future Appreciation Clause Samples
The Future Appreciation clause defines how any increase in the value of an asset, such as real estate or equity, will be handled between the parties after the agreement is executed. Typically, this clause outlines the method for calculating appreciation, the time frame during which appreciation is measured, and how any resulting gains are to be distributed or shared. Its core practical function is to ensure that both parties have a clear understanding of their respective rights to any future increase in value, thereby preventing disputes and allocating potential financial benefits fairly.
Future Appreciation. Sellers acknowledge and understand that as a result of the sale of the Sellers’ Shares, Sellers will be foregoing any opportunity Sellers may have to realize appreciation in the value of the Company and/or the Shares.
Future Appreciation. On each Anniversary Date the Director's total number of phantom shares, other than phantom shares awarded in the Plan Year, shall be valued at the Equity Per Share on the Anniversary Date. The change in value from the prior Anniversary Date shall be added to or subtracted from the Stock Appreciation Account. In no event will the value of the Stock Appreciation Account in regard to any phantom share be reduced below zero.
Future Appreciation. The aggregate consideration to be received by Slack’s stockholders in the first merger consists, as of the unaffected date, of 43% Salesforce common stock, which allows Slack’s stockholders to participate in the future growth of Salesforce and, indirectly, Slack, including any potential appreciation that may be reflected in the value of the combined company (including any resulting synergies) and to attain liquidity should any Slack stockholder choose not to retain its shares of Salesforce common stock.
Future Appreciation. The Seller acknowledges and understands that as a result of the sale of the 10,000,000 Shares to the Purchasers, the Seller will be foregoing any opportunity the Seller may have to realize appreciation in the value of CME and/or any of the 10,000,000 Shares.
