Common use of Future Subsidiary Guarantees Clause in Contracts

Future Subsidiary Guarantees. (a) If, after the Issue Date, any Restricted Subsidiary that is not already a Subsidiary Guarantor Guarantees (or otherwise becomes liable for) Indebtedness of the Company or a Subsidiary Guarantor under a Credit Facility then such Subsidiary will become a Subsidiary Guarantor by executing and delivering a supplemental indenture, in the form of Exhibit B, to the Trustee within 20 days of the date on which it Guarantees such Indebtedness.

Future Subsidiary Guarantees. (a) If, after the Issue Date, any Restricted Subsidiary that is not already a Subsidiary Guarantor Guarantees (or otherwise becomes liable for) Indebtedness of the Company or a Subsidiary Guarantor under a Credit Facility then such Subsidiary will become a Subsidiary Guarantor of the Notes Obligations by executing and delivering a supplemental indenture, in the form of Exhibit B, to the Trustee within 20 days of the date on which it Guarantees such Indebtedness.

Future Subsidiary Guarantees. (a) If, after the Issue Date, any Restricted Subsidiary that is not already of the Company other than a Subsidiary Guarantor Guarantees (or otherwise becomes liable for) guarantees any Indebtedness of the Company or a Subsidiary Guarantor under a Credit Facility Facility, then such Restricted Subsidiary will become a Subsidiary Guarantor by executing and delivering execute a supplemental indenture, in the form indenture and deliver an Officer’s Certificate and an Opinion of Exhibit B, to the Trustee Counsel within 20 30 days of the date on which it Guarantees guaranteed such Indebtedness. The form of such supplemental indenture is attached as Exhibit D hereto.
