Common use of Future Treatment of Unallowable Costs Clause in Contracts

Future Treatment of Unallowable Costs. Unallowable Costs shall be separately determined and accounted for by Xxxxxxx, and Xxxxxxx shall not charge such Unallowable Costs directly or indirectly to any contracts with the United States or any State Medicaid program, or seek payment for such Unallowable Costs through any cost report, cost statement, information statement, or payment request submitted by Xxxxxxx or any of its subsidiaries or affiliates to the Medicare, Medicaid, TRICARE, or FEHBP Programs.

These Unallowable Costs shall be separately determined and accounted for in non-reimbursable cost centers by Xxxxxxxthe Released Xxxxx Entities, and Xxxxxxx shall the Released Xxxxx Entities will not charge such Unallowable Costs directly or indirectly to any contracts with the United States or any State Medicaid programProgram, or seek payment for such Unallowable Costs through any cost report, cost statement, information statement, statement or payment request submitted by Xxxxxxx or any of its subsidiaries or affiliates the Released Xxxxx Entities, to the Medicare, Medicaid, TRICARE, VA or FEHBP Programsprograms.
