Common use of FWS-Initiated Adaptive Management Clause in Contracts

FWS-Initiated Adaptive Management. If FWS determines that one or more of the adaptive management provisions in the HCP have been triggered and that Permittee has not changed its management practices in accordance with Chapter 6 of the HCP, FWS will notify Permittee and will direct Permittee to make the required changes. Permittee will report to FWS on its actions or intended actions within thirty (30) days after receiving notice from the FWS and shall make the required changes in the period of time necessary to implement the changes, as agreed to by FWS and the Permittee. These changes are provided for in the HCP and hence do not constitute Unforeseen Circumstances or require amendment of the ITP or HCP.
