Common use of Gas Imbalances, Prepayments Clause in Contracts

Gas Imbalances, Prepayments. Except as set forth on Schedule 7.18 or on the most recent certificate delivered pursuant to Section 8.12(c), on a net basis there are no gas imbalances, take or pay or other prepayments which would require Parent Guarantor, the Borrower or any of the other Credit Parties to deliver Hydrocarbons produced from their Oil and Gas Properties at some future time, without then or thereafter receiving full payment therefor, exceeding 5.0% of the aggregate annual production of gas from the Oil and Gas Properties of Parent Guarantor, the Borrower and the other Credit Parties during the most recent calendar year (on an mcf basis).

Except as set forth on Schedule 7.18 3.24 or on the most recent certificate delivered pursuant to Section 8.12(c5.13(c), on a net basis there are no gas imbalances, take or pay or other prepayments (including pursuant to an Advance Payment Contract) which would require Parent Guarantor, the Borrower or any of the other Credit Parties its Restricted Subsidiaries to deliver Hydrocarbons produced from their the Oil and Gas Properties at some future time, time without then or thereafter receiving full payment therefor, therefor exceeding 5.02% of the aggregate annual production of gas from the Oil and Gas Properties of Parent Guarantor, the Borrower and the other Credit Parties during its Restricted Subsidiaries for the most recent calendar year (year, on an mcf Mcf basis), in the aggregate.
