General ACSA Rights. ‌ Notwithstanding anything else contained in this RFP, express or implied, ACSA may procure the Services in any manner as it may elect, in its sole, absolute and unfettered discretion. ACSA will, in its sole, absolute and unfettered discretion, determine whether to proceed with the Project or the Services or select one or more Proponents to further discuss a Proposal, the Services, the Project, the Proposed Form of Agreement or any other matter for the purpose of determining whether mutually agreeable terms can be reached between ACSA and a Proponent for the Services, or any portion thereof. ACSA is under no obligation to select the lowest priced or lowest cost Proposal.

  • CSEA Rights CSEA shall have the following rights in addition to the rights contained in any other portion of this Agreement.

  • Restoration of Rights and Remedies If the Trustee or any Holder has instituted any proceeding to enforce any right or remedy under this Indenture and such proceeding has been discontinued or abandoned for any reason, or has been determined adversely to the Trustee or to such Holder, then and in every such case, subject to any determination in such proceeding, the Company, the Trustee and the Holders shall be restored severally and respectively to their former positions hereunder and thereafter all rights and remedies of the Trustee and the Holders shall continue as though no such proceeding had been instituted.

By submission of this proposal, Vendor acknowledges this law and if Vendor enters into a construction contract with a Texas TIPS Member under this procurement, Vendor certifies compliance.
