GENERAL COMPLIANCE WITH RESPECT TO THE PLOT. 15.1 Subject to para 12 above, the Allottee’s shall, after taking possession, be solely responsible to maintain the Plot at his/her own cost, in good repair and condition and shall not do or suffer to be done anything in or to the Building, infrastructure of the project, or the Plot, or the staircases, lifts, common passages, corridors, circulation areas, atrium or the compound, common areas, roads and parks etc., which may be in violation of any laws or rules of any authority or change or alter or make additions to the Plot. and keep the Plot, its walls and partitions, sewers, roads, electric cables, water supply lines drains, pipe and appurtenances thereto or belonging thereto, in good and tenantable repair and maintain the same in a fit and proper condition and ensure that the support infrastructure, shelter etc. of the Building plot or the colony is not in any way damaged or jeopardized. 15.2 The Allottee’s further undertakes, assures and guarantees that he/she would not put any sign-board / name-plate, neon light, publicity material or advertisement material etc. on the face / facade of the Plot or anywhere on the exterior of the Project, buildings therein or Common Areas. The Allottee’s shall also not change the colour scheme of the outer walls or painting of the exterior side of the windows or carry out any change in the exterior elevation or design. Further, the Allottee’s shall not store any hazardous or combustible goods in the Plot or place any heavy material in the common passages or staircase of the Building. The Allottee’s shall also not remove any wall, including the outer and load bearing wall of the [Plot/Plot] areas of the project. 15.3 The Allottee’s shall plan and distribute its electrical load in conformity with the electrical systems installed by the Promoter and thereafter the association of allottee’s and/or maintenance agency appointed by association of allottee’s. The Allottee’s shall be responsible for any loss or damages arising out of breach of any of the previously mentioned conditions.

Any damage cause to drain, road, pipeline, electric line and other service line will be reimbursed from allottee to Society/Agency/Promoter as the case may be. d. The Allottee’s Allottee shall be responsible for any loss or damages arising out of breach of any of the previously mentioned conditions. 15.4 That after the conveyance and registration of the Plot by Promoter, the Allottee shall be liable to obtain the requisite Building Permissions, sanctions and approvals for any kind of construction over the plot from the Bhopal Municipal Corporation, Town and Country Planning department and any other concerned local authorities at his/her own costs and responsibility, after submitting drawings & design of the proposed construction and shall strictly abide by the approved building plans, layouts and maps etc. during the said construction. 15.5 That, the Promoter reserves the right to transfer the ownership of the said project in whole or in parts to any other entity such as partnership firms, corporate body(ies), whether incorporated or not, association or agency by way of sale/disposal/joint venture or any other arrangement as may be decided by the Promoter in its sole discretion and the Allottee agrees that he/she shall not be entitled to raise any dispute in this regard before any court of law or authority. 15.6 That the Allottee shall, use the Plot only for the residential purposes and will not give it on rent or lease or sublet the same for any illegal and unlawful purposes. The Allottee shall not be entitled to use the said Plot for any commercial purpose. 15.7 That, the Allottee shall not obstruct the passages, corridors, or any common areas nor shall carry out any alterations in the elevation and outer space, including the colour scheme. In the event the Allottee desire a change/modification or extra work, which can conveniently be accommodated without affecting the overall plan in the sole discretion of the Promoter, the Promoter may agree to carry out such change/modification or extra work, on a reasonable request on the part of the Allottee and only upon the payment of a mutually agreed price according to the estimate prepared in this regard, the payment of such estimated amount being a condition precedent for affecting any such change/alteration and on another written terms & conditions regarding change in specifications of the items and the same shall be read in conjunction with the original terms of this Agreement.

The Allottee’s Allottee shall be responsible for any loss or damages arising out of breach of any of the previously mentioned conditions. 15.4 The entire stamp duty, registration charges and mutation charges, as may be payable on this Agreement to Sale and Conveyance Deed of the Apartment, as also any other or further document that may be executed between the Parties with respect to the Apartment, shall be borne exclusively by the Allottee. 15.5 The Allotee agrees that the even after handing him over of the possession of the Plot, the maintenance, repair, development work and development of other Pots in the Project and in the common areas, as also the development and construction work in the remaining Phases of the Project may go on. The Allottee agrees not to cause any hindrance, obstruction, obstacles to any such work being carried on by the Promoter or any other Allottee. 15.6 That the Allottee hereby agrees that the Promoter shall be free to transfer the convenient shopping apartment/areas and the Plots reserved for School (if any) for establishing and operating school, in favour of any person/organisation of as per its own choice. 15.7 That the Allottee agrees that the Promoter shall have the exclusive right to occupy and use the site office site office developed by it. 15.8 That as mentioned above, the Total Sale Price is inclusive of the charges for electrical connectivity to the Apartment. However the Allottee shall have to bear the charges for Electrical Meter Connection for his/her individual Apartment and deposit the same with the concerned Electricity Provider Company/MPEB, as the case may be, of appropriate load, depending upon the total electrical load sanctioned for the entire Phase or for all the phases in the Project. 15.9 That the Promoter shall have the first lien and charge on the said Plot, un-till all its dues and other sums and payments as detailed in the Payment Plan are completely paid and discharged, by the Allottee to the Promoter 15.10 That the Allotee shall after obtaining possession, use the aforesaid Plot only for the residential purposes and will not give it on rent or lease or sublet the same for any commercial activity or for any illegal and unlawful purposes. 15.11 That Separate motor pumps may be installed in the project for filling up of the Sump Tanks and for supplying the water to the individual Plots. These pumps will supply fresh drinking water as well as water for other use. The water shall be stored in underground water tanks and from it shall be supplied to the individual Plots and to their respective over head water tanks. No resident shall be allowed to connect pumps directly to the main supply line/sump well of the Project. The expenses for the operation of water supply system and supply of water to individual Apartments shall be borne out of the Maintenance Charges, which may be revised by the Association of Allotees, from time to time. Lifting of water from the individual sump tank to the over head water tanks shall be the responsibility of the individual purchaser/resident, as stated above. 15.12 That if the water is procured from bore xxxxx, then the Allottee has clearly understood that since the bore-xxxxx being provided by the Promoter are natural resources and if afterwards due to any reason whatsoever, the water level goes down and the discharge capacity decreases, the Association of Allotees, will manage their water requirements from other alternative sources/resources or new bore xxxxx at their own cost. Promoter will not be responsible for this, in the future.

Plot and keep the Plot, its walls and partitions, sewers, roads, electric cables, water supply lines drains, pipe and appurtenances thereto or belonging thereto, in good and tenantable repair and maintain the same in a fit and proper condition and ensure that the support infrastructure, shelter etc. of the Building plot or the colony is they are not in any way damaged or jeopardized. 15.2 The Allottee’s Allottee further undertakes, assures and guarantees that he/she would not put any sign-board / name-plate, neon light, publicity material or advertisement material etc. on the face / facade of the Plot or anywhere on the exterior of the Project, buildings therein or Common Areas. The Allottee’s shall also not change the colour scheme of the outer walls or painting of the exterior side of the windows or carry out any change in the exterior elevation or design. Further, the Allottee’s Allottee shall not store any hazardous or combustible goods in the Plot or place any heavy material in the common passages or staircase of the Building. The Allottee’s shall also not remove any wall, including the outer and load bearing wall of the [Plot/Plot] areas of the projectcommon areas. 15.3 The Allottee’s Allottee shall plan and distribute its electrical load in conformity with the electrical systems installed by the Promoter and thereafter the association of allottee’s allottees and/or maintenance agency appointed by association of allottee’sallottees. The Allottee’s Allottee shall be responsible for any loss or damages arising out of breach of any of the previously mentioned conditions. 15.4 The entire stamp duty, registration charges and mutation charges, as may be payable on this Agreement to Sale and Conveyance Deed of the Apartment, as also any other or further document that may be executed between the Parties with respect to the Apartment, shall be borne exclusively by the Allottee. 15.5 The Allotee agrees that the even after handing him over of the possession of the Plot, the maintenance, repair, development work and development of other Pots in the Project and in the common areas, as also the development and construction work in the remaining Phases of the Project may go on. The Allottee agrees not to cause any hindrance, obstruction, obstacles to any such work being carried on by the Promoter or any other Allottee. 15.6 That the Allottee hereby agrees that the Promoter shall be free to transfer the convenient shopping apartment/areas and the Plots reserved for School (if any) for establishing and operating school, in favour of any person/organisation of as per its own choice. 15.7 That the Allottee agrees that the Promoter shall have the exclusive right to occupy and use the site office site office developed by it, till the development and construction work of all the Phases is complete in every sense. 15.8 That as mentioned above, the Total Sale Price is inclusive of the charges for electrical connectivity to the Apartment. However the Allottee shall have to bear the charges for Electrical Meter Connection for his/her individual Apartment and deposit the same with the concerned Electricity Provider Company/MPEB, as the case may be, of appropriate load, depending upon the total electrical load sanctioned for the entire Phase or for all the phases in the Project. 15.9 That the Promoter shall have the first lien and charge on the said Plot, un-till all its dues and other sums and payments as detailed in the Payment Plan are completely paid and discharged, by the Allottee to the Promoter

The unit shall be intended for personal use as residence by such person. The Allottee further agrees that he shall not store any goods of hazardous or combustible nature or prohibited goods and/ or which can cause damage to the construction or structure of the building. 15.5 The Allottee further agrees that he shall not display any name, address, signboard and/ or advertisement material on the external façade of the structure except the name of the unit owner as per the signage guidelines provided by the PROMOTERS. 15.6 THE Allottee shall not at any time demolish or cause to demolish his unit or any part thereof, nor shall at any time make or cause to be made, any additions or alterations of whatsoever nature to the said unit or any part thereof, or any alterations in the elevation/ arcade, closing/ covering of the verandah or lounge or balconies change the outside color scheme of the said unit/ building and shall keep the partition walls, sewers, drains, pipes in the said premises and appurtenances there to, in good tenantable repairs and conditions and shall not chisel or in any manner damage the columns beams walls, stalls, RCC Pardis, carry out retaining walls or other structural alterations in the said unit. 15.7 AFTER the possession of the premises is hand ed over to the Allottee, any additions or alterations in or about or relating to the said unit shall be carried out by the Allottee in co-operation with the Allottees of the other units in the said township at his own costs and the ‘PROMOTERS’ shall not in any manner be liable or responsible for the same and for any damage caused to the bungalow. No such work shall be carried out without the permission of the concerned competent authority and adjoining unit holders. 15.8 THE Allottee shall not to throw dirt, ru bbish, rags, garbage or other refuse or permit the same to be thrown from the said unit in compound or any portion of the said land or project land. 15.9 After the execution of the sale deed , the insurance of the Unit shall be the sole discretion and at the ex pense of the unit owner/ s. THE Allottee shall not do or permit any act or thing which render any insurance of the said property and the adjoining units void or voidable or any part thereof or whereby any increase in premium shall become payable in respect of the insurance by the other unit holders in the township. 15.10 That the Allottee has understood that the common amenities like gardens, common roads, drainage, sewers, water pipe lines, street light, LPG Gas supply systems if any Borewell, etc., shall be the common property and shall be available for common use by all the Allottee/ s of the units in the said project. The Allottees of the units in the said project and the different common organization will have unrestricted right of way in common spaces, gardens, roads and in project for laying of pipelines, telephone and electric cables, sewerage and drainage line etc. 15.11 THE Allottee shall use community spaces, services in the project as per stipulated terms, condition, rules and regulations framed for the purpos e by the ‘PROMOTERS’ or maintenance society/ Company. The Green Lawns, gardens shall not be permitted to be used for conducting personal functions like marriage, parties etc. 15.12 THE Allottee shall from the date of Possession/ Deemed possession maintain the said unit and carry out all internal up keep & repairs therein, at its own cost, so as to keep the said unit in good tenantable state and condition and shall not do or suffer to be done anything, in or to the neighboring areas or any part of the township or the project, staircase or common passage, infrastructure facilities/ amenities, which may be against the rules, regulations and byelaws of the society/ Company or concerned local authority and/ or public authorities and/ or the ‘PROMOTERS’. 15.13 The Allottee hereby agrees to abide by all the terms & conditions of the application for allotment and this letter of Allotment and the applicable laws and to indemnify and to keep indemnified ‘PROMOTERS’ for any such act that result in the loss owing to any contravention or non-compliance of any of the provisions of the application for allotment and this agreement. 15.14 THE Allottee shall take electricity and water connections from the various agencies in this respect. The ‘PROMOTERS’ will provide all necessary co -ordination in a vailing such permanent electricity connection and till the time the permanent electricity connection shall be issued by the MPKVV Co. ltd. or other concern authority, Allottee agrees to avail electricity facility through temporary connection from concern electricity providing company or ‘PROMOTERS’. It is further agreed that the Allottee shall pay all such charges, Fees, penalties & interest for such electricity connection, as may be levied by the authority giving the connection. Charges are detailed as per para 1. 15.15 The Allottee or the society/ company/ body formed by the Allottee shall not object or place any hindrance to the other unit owners. 15.16 ALL charges including proportionate charges payable to various department for obtaining service connections to the said unit like electricity, telephone, piped gas, Narmada water etc, including security deposits for sanction and release of such connection as well as informal charges pertaining thereto will be payable by the applicant in addition to the price of the sai d unit.
