GENERAL EXCLUSIONS. We do not insure for loss caused directly or indirectly by any of the following. Such loss is excluded regardless of any other cause or event contributing concurrently or in any sequence to the loss. These exclusions apply whether or not the loss event results in widespread damage or affects a substantial area.

GENERAL EXCLUSIONS. 6.1 For this insurance, the right to payment does not exist, or the insurance contract will be terminated, if: a. It appears that the insured person has made (one) incorrect statement(s) regarding his health when taking out the insurance or if it appears that the insured is otherwise acting or has acted in conflict with obligations under Title 7.17 of the Dutch Civil Code; b. an insured person has died as a result of a crime committed by a beneficiary and/or as a result of a deliberate act, deliberate negligence or gross negligence on the part of a beneficiary; this only applies to the extent that the payment would directly/indirectly benefit the beneficiary; c. the death is the result of: - participation in combat operations as a soldier in war zones during war missions and humanitarian missions. For Dutch soldiers or civil servants employed by the Ministry of Defence, an agreement has been concluded between the Dutch Association of Insurers and the Ministry of Defence. If there is a mission specially designated by the Ministry of Defence and the requirements set out in the agreement are also met, the insured amount will be paid out or a maximum of EUR 400,000 if the insurer can receive part of this amount back from the Ministry. The complete text of the agreement is available at xxx.xxxxxxxxxxxx.xx; - suicide or attempted suicide. However, this only applies if the (attempted) suicide has taken place within two years after the commencement date or if the insurance has been put back into operation. The will and/or mental state of the insured person will not be taken into account in the assessment of the act or the death as a result thereof. The above does not apply if the death of the insured person is the result of euthanasia in accordance with the standards set by law and/or jurisprudence. An increase in the insured amount (death risk cover) is considered an independent insurance for the purposes of this provision. This means that in the event of (attempted) suicide within two years after the increase in the insured amount, the amount applicable before the increase will be paid out; - an aircraft accident, unless the insured is involved in this accident as: o the passenger on an aircraft;
GENERAL EXCLUSIONS. This ‘Warranty’ does not apply to any defects or performance failures comprising or resulting from any of the following. • When the ‘Products’ are not installed as specified in the Installation Manual • When the ‘Products’ are installed by a person lacking the appropriate electrical qualification and license/certificate for the battery installation required by the law, including country and state jurisdictions. • When the ‘Products’ are not purchased through authorized sales channel designated by LG Energy Solution. • When the ‘Products’ are not installed and/or serviced by the ‘Certified Installer’ of LG Energy Solution. • When the ‘Products’ are not manufactured by LG Energy Solution. • When the ‘Products’ are transported, stored, installed, assembled, tightened, or wired out of compliance of the official installation manual and datasheet of the ‘Products’. • When the ‘Products’ are disassembled or dismantled without prior consent of LG Energy Solution. • When the ‘Products’ are damaged by physical or electrical stresses such as, inclusive but not exclusive of, inrush current, lightning, flood, tidal wave, fire, or incidental damage. • When the defect or performance failure occurs or the scope of the defect expands due to improper repair of the ‘Products’ carried out by technicians who are not approved by LG Energy Solution and/or instructed by the ‘Buyer’ without the consent of LG Energy Solution. • When the defect or performance failure occurs in the ‘Products’ due to the wilful misconduct or negligence of the ‘Buyer’ or ‘Reseller’. • When the defect or performance failure occurs due to the misuse, faulty use, or negligent use of the ‘Products’. • When the ‘Products’ are used for purposes other than the Application under Article 4 and Attachment 1. • When a claim is raised for the ‘Products’ after the warranty period specified in Article 3 and Article 4 has expired. • When the scope of the defect or performance failure has expanded because LG Energy Solution or the ‘Reseller’ were not notified of the defect or failure in the period specified in Article 5. • When the defect and/or any expanded scope of the defect are caused by force majeure events, such as war, riot, civil war, natural disasters, etc., that are not wholly or predominantly attributable to the acts or omissions of LG Energy Solution. • When the ‘Products’ are externally damaged but its performance and function are not affected. • When the ‘Products’ are damaged during the transportation f...

GENERAL EXCLUSIONS. In addition to exclusions listed throughout the Agreement, the following are not covered: 1. Benefits and related services, supplies and drugs that are not Medically Necessary for the treatment of an illness, injury, or physical disability, that are not specifically listed as covered in the Agreement, except as required by federal or state law. 2. Follow-up services or complications related to non-Covered Services, except as required by federal or state law. 3. Services or supplies for which no charge is made, or for which a charge would not have been made if the Member had no health care coverage or for which the Member is not liable; services provided by a family member, or self-care. 4. Convalescent Care. 5. Services to the extent benefits are “available” to the Member as defined herein under the terms of any vehicle, homeowner’s, property or other insurance policy, except for individual or group health insurance, pursuant to medical coverage, medical “no fault” coverage, personal injury protection coverage or similar medical coverage contained in said policy. For the purpose of this exclusion, benefits shall be deemed to be “available” to the Member if the Member receives benefits under the policy either as a named insured or as an insured individual under the policy definition of insured. 6. Services or care needed for injuries or conditions resulting from active or reserve military service, whether such injuries or conditions result from war or otherwise. This exclusion will not apply to conditions or injuries resulting from previous military service unless the condition has been determined by the U.S. Secretary of Veterans Affairs to be a condition or injury incurred during a period of active duty. Further, this exclusion will not be interpreted to interfere with or preclude coordination of benefits under Tri-Care. 7. Services provided by government agencies, except as required by federal or state law. 8. Services covered by the national health plan of any other country. 9. Experimental or investigational services. KFHPWA consults with KFHPWA’s medical director and then uses the criteria described below to decide if a particular service is experimental or investigational. a. GENERAL EXCLUSIONS. Company shall not be under any obligation to pay for or provide any products or services not explicitly set forth in this Agreement, including but not limited to, payment or reimbursement of any hospital, medical expenses, transport or any services not arranged and provided by Company. Any such expenses shall bethe sole responsibility of the Member. Member acknowledges and agrees that this Agreement relates only to the rendering of services and the provision of certain related products as specified herein. This Agreement is not, nor shall it be deemed or construed as, a policy of insurance of any kind or nature.
