General Release Payment Sample Clauses
General Release Payment. From the Gross Fund, Plaintiff's Counsel shall seek a General Release Payment of Ten Thousand Dollars and Zero Cents ($10,000.00) for each of the General Release Payment Recipients, as payment for their involvement in commencing and litigating the claims represented in this Litigation and their involvement in preparing for mediation for the benefit of all Potential Opt-In Plaintiffs, and as specific consideration for their granting of a general release of their individual claims only. ▇▇▇▇▇▇▇ ▇▇▇▇▇ shall not oppose this request. The Settling Parties expressly agree that the Court's approval or denial of any request for General Release Payments is not a material condition to this Agreement, and is to be considered by the Court separately from the fairness, reasonableness, adequacy, and good faith of the settlement. Any order or proceeding relating to the application by Plaintiff's Counsel for General Release Payments shall not operate to terminate or cancel this agreement.
General Release Payment. The Named Plaintiff shall be entitled to seek, for his participation in the Action, in addition to the Individual Settlement Payment to which he may be entitled, an amount up to Six Thousand Dollars and Zero Cents ($6,000.00) (the “General Release Payment”). ABC agrees to not oppose such application. In exchange for the General Release Payment, the Named Plaintiff will execute the General Release (defined below). The General Release Payment, subject to Court approval, shall be paid from the Settlement Amount.
General Release Payment. At the same time that Named Plaintiff files a motion for Class Counsel’s attorneys’ fees and costs, Named Plaintiff may also seek approval of a general release payment (the “General Release Payment”) of ten thousand dollars ($10,000.00). The Settlement Administrator shall make Named Plaintiff’s motion and any attachments available on the Settlement website as soon as practicable after the motion is filed. In the event this request for a General Release Payment is approved by the Court, the Settlement Administrator shall issue a check from the Settlement Account made payable to Named Plaintiff at the same time that the Settlement Administrator pays Class Counsel’s attorneys’ fees and costs. Defendant agrees not to oppose Named Plaintiff’s request for a General Release Payment. Any portion of the General Release Payment not approved by the Court will be allocated among Class Members as part of the Settlement Fund. The procedure for and the allowance or disallowance of any General Release Payment are matters separate and apart from the Settlement. Any order or proceeding relating to the General Release Payment, or any appeal from any order relating thereto, or any reversal or modification thereof, shall have no effect on the Settlement, and shall not operate to, or be grounds to, terminate or cancel the Agreement or to affect or delay the finality of the Final Approval Order or any Judgment.
