Generally; Availability. The form of the New Contract has been provided to and approved by the SBI. The terms and conditions of the New Contract are incorporated herein by reference and made a part of this Agreement except as otherwise provided. The New Contract shall be available for use in connection with the Plan on the Effective Date of this Agreement or as soon thereafter as the registration statement covering the New Contract shall have been declared effective by the United States Securities and Exchange Commission, but in no event later than September 30, 1994, or such later date as may be approved by the SBI. Salary deferrals and/or purchase payments received prior to such date shall continue to be allocated to the Prior Contracts.
