Generator’s Facility and Interconnection Facilities. Except for changes deemed by the Operating Agent to be necessary to ensure the protection and safety of Parties’ personnel and the safety and reliability of Parties’ property, Generator shall not be required to make any modifications to the Facility or Generator’s Interconnection Facilities unless such change is consistent with Good Utility Practice and required (i) as a result of a change in the Facility or (ii) as a result of a change on any of the Utilities’ electric systems which is required by Good Utility Practice. Generator shall not be responsible for the cost of any such modifications and the cost of operating and maintaining such modifications unless required by Applicable Laws and Regulations or such modifications are required as a result of a change in the Facility made by Generator.
